Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the SurgeAOV Shopify App (the "App"), developed to optimize Average Order Value via automated volume discounts, quantity breaks, in-cart upsells, and free shipping bars on Shopify storefronts. By installing or using the App, you agree to be bound by these Terms.

1. License and Permitted Use

SurgeAOV grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on your authorized Shopify storefronts. You agree that you will not:

• Reverse engineer, decompile, or attempt to extract the source code of the App or embedded theme scripts.
• Use the App to display misleading, deceptive, or unauthorized discount claims to consumers.
• Circumvent or attempt to manipulate the billing and usage metering mechanisms built into the App.

2. Theme Embeds & Store Integrations

SurgeAOV integrates with your store via Shopify Online Store 2.0 Theme App Extensions. You represent and warrant that you have the explicit authority to install theme embeds on your storefront. We strive for seamless compatibility across standard Shopify liquid themes, but are not responsible for conflicts caused by custom third-party theme modifications.

3. Subscriptions, Billing, and Usage Limits

The App is offered on a subscription basis, billed directly through the Shopify Billing API on your regular monthly Shopify store invoice. Plans include a 14-day free trial for first-time installations. Switching plans is prorated automatically by Shopify. All charges are processed according to Shopify's recurring application billing terms.

4. Data Accuracy and Liability

While SurgeAOV strives for high reliability and 99.9% uptime, discount calculation and cart rendering are subject to network latency and Shopify API availability. SurgeAOV is not liable for any direct, indirect, incidental, or consequential damages resulting from theme layout variations, checkout errors, or lost sales.

5. Termination

You may terminate this agreement at any time by uninstalling the App from your Shopify store. We reserve the right to suspend or terminate access to the App immediately, without prior notice, if you breach these Terms.

6. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the App following such modifications constitutes your acceptance of the revised Terms.
